Terms of sale

The owner of the online store www.biolanshop.eu (hereinafter the Online Store) is Biolan Oy (BIC 0132209-5) located in Lauttakyläntie 570, FI-27510 Eura, FINLAND (hereinafter Biolan or we/us/our).

Validity of the sales contract, product, and price information.

The terms of sale apply to the purchase of products from the Online Store.

The prices of the products sold in the Online Store are indicated next to the products and the prices are in euros. Prices include VAT, unless otherwise stated. The delivery fee is added to the cost of the products. Information about delivery fees is provided in the Online Store, in your shopping cart, before proceeding to checkout. Information about the product is provided directly with the product, on the corresponding website.

We reserve the right to change these terms of sale at our sole discretion without any prior notice. Orders are subject to the terms of sale valid at the time of order, which can be read on the Online Store.

Placing the order.

To order the products, you must add the products to the shopping cart. You can add several products to the shopping cart and continue shopping at the same time. After you have finished shopping, go to the shopping cart by pressing the red “View Cart” button. In the shopping cart, you will see information about the cost of the product(s), including shipping.

To complete the order, you must fill in the required data fields and select the appropriate method of product delivery. The delivery fee will be shown in the order process before you complete your order and you confirm your consent to this fee when you submit your order. Payment in the Online Store takes place via PayPal. Further information on payments by using PayPal is available here. The contract enters into force when we receive payment from you.  If the ordered products cannot be delivered due to a cause beyond our control, you will be informed of this as soon as possible and the money paid (including the costs of delivering the products) will be returned without delay, but no later than within 14 days of sending the notice.

You need to ensure that the personal data and other order information you provide in the Online Store order form is correct and complete. You have the responsibility to check and go through the correctness of the information in your order in all respects before ordering and paying.

Delivery.

Products are sent to the following EU countries: Austria, Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden.

We currently deliver exclusively to mainland destinations and cannot extend services to islands. Our products are subject to VAT, and a 0% rate is not available at this time.

The delivery cost is added to the price of the products sold in the store. The delivery time is from 2 working days. The delivery time from which the product arrives at the delivery address is indicated on the product card. The delivery cost applies to one delivery. Please note that the delivery time is an indicative delivery time offered by the system. The delivery price is calculated based on the product, according to the volumetric weight, as well as based on the location after entering the unloading address in the purchase process. The shipping price is displayed in the shopping cart when paying for the purchase.

If the “delivery time” falls on a weekend or public holiday, the order will be delivered on the following working days.

By entering your postal code in the shopping cart, we can find the exact cost of the final delivery price to your door. You can pay for both the transport service and the goods at the same time. Shipments are delivered to the agreed unloading location, and the customer must ensure the possibility of unloading the shipment at the destination address.

The product card shows the estimated delivery time.

Shipments of in-stock products are dispatched from our warehouse within 2-3 business days of your order being placed. Delivery time varies depending on the selected shipping option and delivery country.

Shipments generally arrive at the destination specified by the buyer within 7-10 business days of your order being placed. In exceptional cases, we have the right to deliver the goods within 45 calendar days.

If delays outside of our control occur, we will make every effort to keep you informed. For the avoidance of doubt, time is not of the essence for the delivery of the products, but you will remain entitled to all statutory rights provided to you by the applicable laws. However, we will not be liable for any possible damages caused by a delay if the delay is due to a cause beyond our control.

After receiving the delivery, you must check that the delivery has included the products you have ordered and that the products are defect-free. If you notice an error in the order or product, you must report it to the Online Store customer service.

We have the right to withdraw from the sales transaction and demand the return of the products from you (if already delivered) if the price of the products in the Online Store is marked significantly below the market price of the products due to an error.

Return conditions.

Consumer customers have the right to return the products they have purchased within fourteen (14) days of receipt. This right of withdrawal does not apply if the buyer is a legal entity. In order to use the 14-day right of return, the ordered products must not be used in any other way than what is necessary to verify the nature, characteristics and functioning of the products. If the products have been used for purposes other than what is necessary to verify the nature, characteristics and functioning of the products, or if they show signs of use, we have the right to reduce the refundable fee according to the decrease in the value of the products. In order to return the products, you must submit an application for withdrawal from the purchase of the products, the form of which can be found here, and send it to the e-mail address biolanshop@biolan.com within 14 days of receiving the products at the latest. The cost of returning the products is borne by you, unless the reason for the return is that the product to be returned does not correspond to what was ordered (e.g. a wrong or defective product). Products to be returned must be packed carefully. You must return the products within 14 days after submitting the application or provide proof that you have handed over the products to the carrier of the products within the aforementioned period.

Upon receipt of the returned products, we will return to you immediately, but no later than 14 days after receiving the withdrawal, all fees received from you under the contract. We may refuse to issue refunds until we have received the product that is the subject of the contract or until you have provided evidence that you have returned the product, whichever occurs first.

Please note that all substrates ARE NOT EXCHANGEABLE and NOT REFUNDABLE after their package has been opened.

Responsibility for defects.

The potential warranty for products is determined in accordance with the warranty conditions defined by the manufacturer. You are obliged to familiarize yourself with the warranty conditions supplied with the product before using the product. The warranty conditions can be found in the instructions for use, a separate warranty form or at the manufacturer’s website. As a rule, the warranty only covers manufacturing and material defects in the product. The warranty period is specified in the product information. Warranty repair or replacement does not extend the product’s original warranty period.

Warranty repair is always carried out in accordance with the manufacturer’s or importer’s warranty conditions. We direct you to contact the manufacturer or their service company directly, as this speeds up the service and is therefore in your best interest. You can always deliver the product to our service point as well.

Biolan is responsible for the products’ statutory liability for errors when the product’s warranty has expired or no warranty has been granted. You can get more information by emailing biolanshop@biolan.com.

Biolan is not responsible for damages caused by the buyer’s actions or omissions.

Force majeure situations.

We are not responsible for product defects, delivery delays or other breaches of contract caused by circumstances beyond our control (force majeure). In such a situation, we will comply with our obligations in the Online Store as quickly as possible in the described situation after first contacting you and verifying whether you still want to receive the order.

Direct marketing and personal data processing.

We handle your personal data confidentially. You can find a detailed description of the processing of personal data in Biolan’s privacy policy.

We transmit personal data to companies providing transport services in order to deliver the products.

We send you newsletters and offers to your e-mail address only if you have expressed your wish to receive such direct e-mail notifications. You can opt out of offers and newsletters at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.

Applicable law and dispute resolution.

Purchases of products at Online Store are subject to Finnish law.

If you have a complaint about your purchase, please do not hesitate to contact our customer services.

If you are a consumer customer residing in Finland and we fail to find a satisfactory solution, you can refer the matter to the Finnish Consumer Disputes Board (www.kuluttajariita.fi). Before taking the case to the Consumer Disputes Board, the consumer must contact the magistrates’ consumer advisory service (www.kuluttajaneuvonta.fi). If you are a consumer customer residing in another EU-country than Finland, and the conditions are met, you may use the European Commission online dispute resolution for your complaint (www.ec.europa.eu/odr).

All claims or disputes arising in relation to or in connection with any contract (any order for products) under these Terms and Conditions shall be governed by Finnish law except for its principles and rules on conflicts of laws.

All claims or disputes arising in relation to or in connection with any contract (any order for products) under these terms of sale shall be settled by a competent Finnish court.
